On April 24, the People’s Court of Ho Chi Minh City continued to trial defendant Tran Qui Thanh (former Director of Tan Hiep Phat Trading and Services Co., Ltd.) and his two daughters, Tran Uyen Phuong (born 1981) and Tran Ngoc Bich (born 1981). Born 1984).

The representative of the Ho Chi Minh City People’s Procuracy proposed to sentence defendant Tran Qui Thanh to 9-10 years in prison, Tran Uyen Phuong to 5-6 years in prison and Tran Ngoc Bich to 4-5 years in prison.

The representative of the People’s Procuracy determined that the nature of the property transfer contract between Mr. Thanh and the four victims, including Dang Thi Kim Oanh, Nguyen Van Chung, Lam Son Hoang, and Nguyen Huy Dong (both living in Ho Chi Minh City), was a loan. However, this lending is hidden by project asset/share transfer contracts.
Specifically, during 2019-2020, Mr. Thanh and his two daughters lent money to the above 4 individuals at an interest rate of 3%/month. Lenders do not prepare loan documents but require those who need to borrow money to sign a property transfer contract. These assets include real estate and shares of real estate projects.
This form of contract is determined to be a sham, a fake agreement to hide the loan. When the borrower fully fulfilled its obligation to repay principal and interest as agreed, Mr. Thanh and his son complained for many reasons not to return the property to the property owner.
According to the People’s Procuracy, defendant Tran Qui Thanh was the one who directly communicated with the borrower, so he must bear the main responsibility.
The prosecutor retains the right to prosecute and previously assessed that the defendants were not sincere. However, through questioning in court, they were aware of their actions and honestly confessed. The defendants have the aggravating factor of committing the crime twice or more.
