During the argument, the representative of the People’s Procuracy of Quang Ngai province said that defendants Nhat and Thuy actively beat shipper Dat.

First, because of very minor conflicts related to delivery fees, defendant Nhat did not receive the goods even though shipper Dat proactively called the seller so the two sides could talk.

From here, defendant Nhat and shipper Dat had an argument. Shipper Dat also went to the truck to pack up the goods and leave. But with his thuggish nature, defendant Nhat kicked shipper Dat’s helmet. When Mr. Dat reacted, Nhat continued to fight.

What happened next, Dat defended himself, grabbed the chair and grabbed Thuy’s collar. Defendant Nhat immediately used an iron pipe to hit shipper Dat in the head 3-4 times from above. Dat used a chair to support him, then went to the car with the intention of leaving.

At this time, Thuy did not notice that the necklace around her neck had broken into two pieces, fell to the ground and stuck to the person who told Dat to return it. Even though Dat raised her hand to say no, Thuy still hugged her leg and pulled the gate to let her husband continue. continued to use an iron pipe to hit him very hard on the head with the intention of killing him.

With its argument, the prosecutor’s office proposed a sentence of 5 years – 5 years and 6 months in prison for Nhat and 2 years – 2 years and 6 months in suspended prison for Thuy.

The prosecutor’s argument caused the two defense lawyers for defendants Nhat and Thuy to not defend anything more that the blows aimed at people’s vital positions were the first step to commit the act of murder, only stating that Defendants Nhat and Thuy had low education and lack of understanding of the law, which led to their crimes and agreed with the sentence given by the prosecutor’s office.

Committed many crimes but still aggressive

After the deliberation, Judge Nguyen Van Nam, presiding judge, representing the jury commented Defendant Truong Dinh Nhat have full capacity for civil acts and are fully aware of their own behavior. Just because of very small conflicts about delivery fees, defendant Nhat did not agree to receive the goods, but with his thuggish nature, the defendant repeatedly used an iron tube to hit the victim on the head with the aim of taking his life. Furthermore, defendant Nhat committed crimes many times but did not take it as a lesson or change himself. On the contrary, it is a more serious crime.

The defendant’s behavior was particularly serious, negatively affecting local security and order. The Procuracy prosecuted defendant Nhat for murder and was the right person. But the jury did not accept the sentence imposed by the representative of the prosecutor’s office, but based on the law, the jury sentenced defendant Nhat to 9 years in prison.

As for defendant Thuy, the court found that Thuy had the capacity to perceive civil behavior and control her behavior.

Defendant Thuy did not intervene but used a stainless steel chair to beat Dat, then held his feet and closed the gate so defendant Nhat could beat shipper Dat.

“Defendant Thuy’s actions were to strengthen the will and create favorable conditions for defendant Nhat to beat shipper Dat with the purpose of murder. The prosecution of murder against defendant Thuy is well-founded.

Considering the behavior, nature and level of danger to society, the jury did not agree with the sentence imposed by the prosecutor’s office and sentenced defendant Thuy to 3 years in prison.

At the same time, the court read the arrest warrant for defendant Thuy right at the trial.

After pronouncing the verdict, the jury gave defendants Nhat and Thuy the right to appeal. The appeal period is 15 days.

The victim asked for relief for the defendant

In this case, shipper Dat, despite having both arms broken and his health seriously damaged, was the one who asked the court to consider reducing the punishment for defendants Nhat and Thuy. Regarding the civil part, after defendant Nhat’s family visited his home and paid 100 million VND in compensation, shipper Dat also dismissed the civil claim for the defendant and his wife.

Along with the sincere testimony, the victim’s tolerance was a mitigating circumstance that the jury offered to consider for the two defendants.
