According to current law, acts of disturbing public order have two types of sanctions: administrative sanctions and criminal sanctions. For acts that disrupt public order and result in adverse effects on security, order and social safety, the violator may be criminally prosecuted. This is a qualitative regulation, not a quantitative one. Whether or not a behavior has a “bad impact” depends on the assessment point of view of the authorities. Dr. Lawyer Dang Van Cuong emphasized: “With the initial information, Ngoc Trinh may only be prosecuted under Clause 1, Article 318 of the Penal Code with a penalty frame of a fine from 5,000,000 VND to 50,000 VND. 000 VND, non-custodial reform for up to 02 years or imprisonment from 03 months to 02 years. This is a less serious crime as prescribed in Article 9, Penal Code. In case of conviction of the crime This category carries a maximum penalty of up to 02 years in prison, except in cases where the suspect or defendant also committed other crimes (if any).

This is also a way for us to contribute to building a cleaner network environment in the future,” Mr. Nguyen Thanh Hoa shared.

Regulations for handling accounts that violate information on social networks are expected to be completed by the end of this year. In addition, the Department of Information and Communications of Ho Chi Minh City also proposed the Department of Radio, Television and Electronic Information to block violating accounts and prevent them from appearing on social networking platforms.
