Don’t play with the law
Returning to Ngoc Trinh’s case, discussing with Law and Society, Dr. Lawyer Dang Van Cuong – Head of Chinh Phap Law Office (Hanoi Bar Association) said that the investigation agency’s prosecution of Ngoc Trinh for “disturbing public order” is in accordance with the provisions of law. If it is just a road traffic violation committed by a normal person, an administrative fine may be appropriate. However, perhaps the agency conducting the proceedings considers Ngoc Trinh to be a famous person with social influence, and the behavior of artists and famous people will easily have a direct impact on psychology and actions. , habits of young people. Therefore, the illegal behavior of celebrities can cause bad public opinion and can affect the psychology of many people in a negative way, so this behavior has been dealt with drastically to deter and prevent it. common to society.
According to current law, acts of disturbing public order have two types of sanctions: administrative sanctions and criminal sanctions. For acts that disrupt public order and result in adverse effects on security, order and social safety, the violator may be criminally prosecuted. This is a qualitative regulation, not a quantitative one. Whether or not a behavior has a “bad impact” depends on the assessment point of view of the authorities. Therefore, in many cases, people who commit acts of disturbing public order think very simply that their actions will at most only be subject to administrative sanctions without knowing that the authorities can punish them. Considering that this is an act that negatively affects security, order and social safety, it is decided to prosecute a criminal case and prosecute the accused to deal with criminal sanctions.
Regarding Ngoc Trinh’s temporary detention, Dr. Lawyer Dang Van Cuong said:
“In the case of Ngoc Trinh being investigated under Article 318 of the Penal Code and there are grounds to show that if not detained, the defendant may escape or obstruct investigation activities, then the investigation agency will conduct temporary detention for investigation according to the law. laws. Criminal handling in this case has a strong deterrent to famous people in society.”
Dr. Lawyer Dang Van Cuong emphasized: “With the initial information, Ngoc Trinh may only be prosecuted under Clause 1, Article 318 of the Penal Code with a penalty frame of a fine from 5,000,000 VND to 50,000 VND. 000 VND, non-custodial reform for up to 02 years or imprisonment from 03 months to 02 years. This is a less serious crime as prescribed in Article 9, Penal Code. In case of conviction of the crime This category carries a maximum penalty of up to 02 years in prison, except in cases where the suspect or defendant also committed other crimes (if any).
Put scandalous artists on the blacklist
During a regular meeting at the Ho Chi Minh City Press Center in October, the press asked questions to the management agency regarding the recent incident of actress Cat Tuong’s false advertising that caused a stir. Mr. Nguyen Thanh Hoa, Head of Electronic Information Department, Department of Information and Communications (TT&TT) of Ho Chi Minh City, said that the unit has a department specializing in reviewing social networks and checking accounts that spread false news. , which includes artists and celebrities promoting dietary supplements. Accordingly, for individuals and units identified as violators, the Department will consider putting these individuals on the blacklist of the Ministry of Information and Communications and recommended brands, advertising agencies, and businesses. Does not cooperate with channels on this list.
“The Ministry of Information and Communications is coordinating with the Ministry of Culture, Sports and Tourism to develop a white list and black list. Whitelist encourages advertisers to build accounts, supporting them. On the contrary, the blacklist is for violators in advertising who are punished and repeat offenders. This is also a way for us to contribute to building a cleaner network environment in the future,” Mr. Nguyen Thanh Hoa shared.
Regulations for handling accounts that violate information on social networks are expected to be completed by the end of this year. In addition, the Department of Information and Communications of Ho Chi Minh City also proposed the Department of Radio, Television and Electronic Information to block violating accounts and prevent them from appearing on social networking platforms.
Mr. Lam Ngo Hoang Anh, Chief of Office of the Department of Culture and Sports of Ho Chi Minh City, said that the management of artists in the field of advertising is regulated in Article 9, Clause 4 of the Code of Conduct of People. operating in the field of arts (Decision No. 3196/QD-BVHTTDL Minister of Culture, Sports and Tourism signed on December 13, 2021). This content clearly states: “artists participating in advertising activities must ensure to convey truthful, accurate, and clear information about the uses and features of products and goods in accordance with the provisions of law, especially especially products in the fields of health, education and environment.”
Artists are still considered people who contribute to spreading the values of truth – goodness – beauty, making life better. An artist’s success is largely determined by support from the public, so they need to be even more responsible to the public and society. However, many people do not know how to preserve and cherish their own image as well as the affection and trust of the public. Notorious artists who violate the law and professional ethics will, depending on the severity of the violation, receive appropriate penalties. However, the heaviest punishment they have to endure is the audience’s rejection, boycott, and condemnation, which means that all the efforts to build their careers are quickly destroyed, and their path to returning to work is almost blocked. slam. For these artists, the strictness of the public and the authorities is essential to help purify the entertainment industry and set an example for others.
|Dr. Lawyer Dang Van Cuong emphasized: “For famous people who are considered public figures, the required behavior must be in accordance with ethical standards, in accordance with culture, and with fine customs and traditions. and especially must comply with the provisions of the law to avoid celebrities’ behavior that is inconsistent with social standards, causing negative consequences for society, creating different views and lifestyles. deviation, affecting the perception and personality formation of young people. Therefore, Ngoc Trinh’s case will be a lesson for artists in carrying out art, sports, entertainment activities and posting information in cyberspace.”|
