Mr. Giang said that, after 28 years of implementation, the 1994 Ordinance on Protection of National Defense Works and Military Zones revealed problems and inadequacies, some of which did not keep up with the socio-economic development. .

In addition, a number of provisions on restriction of human rights and citizens’ rights in the above ordinance are not consistent with the provisions of the Constitution.

Specifically, the Minister of National Defense said that the determination of the scope and protection boundaries of defense works and military zones has not been specified and clearly defined.

There is also the phenomenon of illegal encroachment and encroachment into the area assigned to manage and protect. Along with that, the coordination between localities, the Ministry of National Defense and military units in determining the scope and boundaries for management and protection has not been implemented synchronously.

Mr. Giang also mentioned the status of developing plans, granting operation permits in a number of socio-economic development projects and the management of foreigners residing in a number of localities and regions related to the project. related to defense works and military zones is not strict…

“The above-mentioned inadequacies make it necessary to develop a law to create a higher legal basis and promptly solve actual problems and inadequacies that arise,” the Defense Minister stated.

Specific, clear, and feasible regulations

Verification, Chairman of the National Assembly Defense – Security Committee Le Tan Toi said that the committee agreed on the need to enact the law.

However, there are opinions that defense works and military zones are mostly attached to land, currently in some localities, encroachment and disputes are still happening. Meanwhile, the solution faced many difficulties and problems.

Therefore, this committee recommends that it is necessary to study the contents of management and protection of defense works and military zones in order to provide specific and clear regulations to ensure feasibility; at the same time, have synchronous, effective and effective solutions to minimize arising problems.

The verification agency of the National Assembly also suggested that the drafting agency continue to review to ensure consistency with relevant laws; synchronized and consistent with the law projects being amended, supplemented and promulgated by the National Assembly.

“Research and supplement an article on transitional provisions to handle outstanding issues and ensure feasibility,” said Mr. Toi.
