Defendant Mien testified in court

On the morning of May 9, 2023, Nguyen Van Mien (born in 1970, living in Phu An 1 hamlet, Binh Hoa commune, Chau Thanh district) drank with 2 friends, then went to play Chinese chess at a restaurant near his house. At about 1:00 p.m., Nguyen Thi Trang (born in 1970, Mien’s wife) said that another duck had just been attacked by a dog at Mr. Bay Toi’s cow farm (Pho Van Toi, born in 1956, living in Binh Khanh ward, City. Long Xuyen) bit him to death.

Hearing that, Mien went home and saw a duck bitten to death by a dog. Mien took her bicycle, carrying the dead duck, and ran to Mr. Toi’s cow farm (about 500m from Mien’s house) to ask for compensation. Upon arriving, unable to find the owner of the cow farm, Mien stood right inside the cow farm, cursing and arguing, challenging Ho Van Tu (born in 1975, Toi’s employee) to a fight.

Angry, Mien rode her bicycle home, took a sharp knife and hid it in her trouser pocket, then returned to the cow farm to talk to Toi. When he arrived, he still didn’t see Mr. Toi. He was still a little drunk, so Mien continued to argue with Tu. Seeing that Tu was young and aggressive, Mien said: “If you curse again, I will fight.” Tu did not stop, so the two started fighting. At this time, Tu held a wooden cow dung scoop, Mien held a gourd knife and rushed into the fight.

The two sides fought for a while, then all their weapons fell. They couldn’t fight back with the youth’s strength, so Mien was pinned to the ground by Tu, sat on him, pressed his hand on his neck, and hit him in the face. Having been hit many times, Mien resisted by using her left hand to support her face, and with her right hand she pulled out a knife from her pocket and stabbed Tu several times, hitting Tu’s shoulder, hip and back. At this time, two people working with Tu ran in to intervene, took away Mien’s knife, threw it away and reported it to Binh Hoa Commune Police. Everyone took Tu to An Giang Central General Hospital for emergency treatment.

After committing the crime, Mien went out, took her bicycle, left the scene, and fled home. After receiving the information, the police force checked and verified the initial source of information and issued an emergency detention order for Mien for the act of “Intentionally causing injury”.

At about 7:15 a.m. on May 10, 2023, Tu died at the hospital. Based on the conclusion of the forensic examination, the cause of Tu’s death was acute respiratory failure and circulatory failure due to a wound in the left shoulder blade that penetrated the left lung. On May 16, 2023, the Provincial Police Investigation Agency prosecuted Mien for the crime of “Murder” to continue investigation and handle according to the law.

After hearing the news, Mien’s family provided 15 million VND to cover Tu’s funeral expenses. Nguyen Thi Ngan Ha (born in 1980, Tu’s wife) asked Mien to compensate the total amount of 489 million VND.

Before the jury, defendant Mien choked up and realized his wrongdoing. Because he was upset that Mr. Toi’s dogs often ran over to him and killed him, he wanted to go find Toi to talk, but was interrupted by Tu. Provocation leads to arguments and fights. “Because he was beaten by Tu, Mien took out a knife and stabbed back, but he didn’t expect Tu to die. The defendant knew he was wrong,” Mien explained.

“The defendant is fully aware of what actions are good, bad, should be done or should not be done. He should have worked hard and been a good example to raise children in the family, but the defendant had an aggressive, thuggish nature and liked to cause fights.

Worth mentioning, because of the defendant’s superiority, it led to heartbreaking consequences for the victim’s family and the defendant’s family, as well as a negative impact on public opinion. Therefore, it is necessary to have appropriate sentences for education, deterrence and general prevention, thereby limiting these violations and contributing to maintaining security and order in the entire society. ” – The jury commented.

At the end of the trial, the Provincial People’s Court sentenced defendant Nguyen Van Mien to 20 years in prison for the crime of “Murder”.
