According to the first-instance criminal judgment, Dinh Thi Huynh is the person who must execute the sentence under the first-instance civil judgment No. 33/2016/DSST, dated August 23, 2016 of the People’s Court of My Xuyen district, which has taken legal effect. law but did not comply with the sentence. Although there are conditions for executing the sentence, Huynh believes that the sentence is not correct so he firmly opposes the execution of the sentence. On February 24, 2022, the enforcement agency enforced enforcement according to regulations to ensure execution of the judgment, but Huynh did not comply and acted fiercely against the enforcement team and the enforcement team. After the enforcement, Huynh continued to violate, returning to build a house and live on the land assigned to the auction winner by the enforcement agency to hinder the execution of the judgment.

On February 1, 2024, the People’s Court of My Xuyen District sentenced Huynh to 2 years in prison for failure to comply with the sentence.
Afterwards, Huynh appealed and at the appeal court asked to consider reducing the penalty. At the appeal court, the jury found that the first instance judgment had sentenced the right person, the right crime, and in accordance with the law, so the appellate court upheld the first instance judgment of the My Xuyen District People’s Court.
