(CTTĐTBP) – On April 23, 2024, the Ministry of Construction issued a guiding document on determining the list of projects, subjects, conditions, and criteria for preferential loans to develop social housing and worker housing. , renovate and rebuild apartments.

Accordingly, the instructions in this document apply to loans under the Credit Program of about VND 120,000 billion according to Resolution No. 33/NQ-CP dated March 11, 2023 of the Government. Contents related to credit laws (loan credit, implementation time, loan interest rates during the preferential period…) are implemented according to the instructions in Official Dispatch No. 2308/NHNN-TD dated January 1. April 2023 of the State Bank of Vietnam on implementing loan programs for social housing, worker housing, renovation and rebuilding of apartments.

Subjects receiving loans

In case of buying social housing or worker housing (social housing in industrial parks) according to the provisions of Clause 1, Article 50 of the 2014 Housing Law, the subjects eligible for loans are the subjects specified in Clauses 1 and 2 of this Article. 1, 4, 5, 6, 7, 8, 10 Article 49 of the Housing Law. Specifically: people with meritorious services to the revolution according to the provisions of law on preferential treatment for people with meritorious services to the revolution; low-income people, poor and near-poor households in urban areas; workers working at enterprises inside and outside the industrial park; officers, professional non-commissioned officers, technical non-commissioned officers, professional soldiers, workers in agencies and units of the people’s police and people’s army; cadres, civil servants and public employees according to the provisions of law on cadres, civil servants and public employees. The subjects returned the official housing according to the provisions of Clause 5, Article 81 of the Housing Law; Households and individuals are subject to land recovery and must clear and demolish houses according to the provisions of law but have not been compensated by the State with housing or residential land.

In case of buying houses in apartment renovation and reconstruction projects, comply with the provisions of Clause 2, Article 26 of Decree No. 69/2021/ND-CP dated July 15, 2021 of the Government on renovation. , rebuilding apartment buildings. Specifically, apartment owners who are resettled but must pay additional area difference can borrow capital from credit institutions and financial institutions operating in Vietnam.

Loan conditions and criteria

In addition to ensuring the conditions and criteria according to the legal regulations on credit guided by the State Bank, subjects eligible to borrow from the VND 120,000 billion credit program must also meet the following conditions and criteria. :

For individuals: Those who buy social housing or worker housing (social housing in industrial parks) must have a social housing purchase contract with the investor according to the law. about housing. For subjects who are resettled in a project to renovate and rebuild an apartment building, there must be a contract to buy, house, and construction work to arrange resettlement in accordance with the law on housing.

For investors of social housing projects, worker housing, renovating and rebuilding apartments, they must be included in the list of social housing projects and worker housing (social housing). in industrial parks), renovating and rebuilding apartments as announced by the Provincial People’s Committee and must ensure the following conditions: For social housing construction projects, housing for workers has been approved by competent authorities. the right to decide investment policies according to the provisions of investment law and housing law; has been selected as a project investor according to the housing law and has had a land allocation decision or has land use rights according to the provisions of the land law. For apartment renovation and reconstruction projects that have had investment policy approval from a competent state agency according to the provisions of law; has been selected as the project investor according to housing law.
