Up to now, she has been confirmed by the Ho Chi Minh City Materials and Technical Services Company and the People’s Committee of Long Binh Ward as the person exploring this land, and at the same time, by the Dong Nai Land Registration Office, Bien Hoa branch. As a person “stuck” in this situation, Mr. Phan Quang Dong, living in Thien Tan commune, Vinh Cuu district, Dong Nai province, said with frustration that the plot of land had been reclaimed by his family since 1980 and continuously cultivated. . However, recently a subject named TTL (residing in Vinh Cuu district, Dong Nai province) asserted that “it is her land” and repeatedly filed disputes, making it impossible for his family to get the paperwork done. More “tired” than Mr. Dong’s family, Mr. Nguyen Anh Hoang’s family, also in Vinh An town, Vinh Cuu district, has had to continuously participate in land dispute conciliation sessions for “2 generations” (nearly 40 years). belt, to date, there are still no results.

In a more difficult situation, Mr. Nguyen Duc Day, living in Quarter 6, Vinh An Town, Vinh Cuu District, affirmed that two plots of land numbered 41, plots 145 and 146, which Mr. Day had explored since 1984, had Certificate from authorities. Currently, Mr. Day has built a prefabricated house on this plot of land, and every year he still plants melaleuca trees.

However, in 2020, when Mr. Day poured soil to level the land, Mr. HMD (residing in Vinh Cuu district, Dong Nai province) and dozens of people came to fence around plot number 145, then built a prefabricated house and planted trees. plants, raising animals, disputes to this day. When Mr. Day petitioned the People’s Committee of Vinh An town, authorities came to the scene to make a record and brought it to the People’s Committee of Vinh An town for mediation but failed. Up to now, Mr. Day has made many applications to the People’s Committee of Vinh Cuu district and Dong Nai province but has not yet been resolved.

When the dispute has not been resolved, it means that, even if it is a legitimate piece of land, the landowners cannot change ownership if necessary or more serious, as in the cases mentioned. above, is not being able to use one’s own land due to constant harassment…

During the conciliation process, Mr. Day’s family was able to provide the official document that the People’s Committee of Dong Nai province had previously allocated land to the family. As for the group of people surrounding the fence, they only had later measurements.

Sharing more, Mr. Nguyen Trung Nang affirmed that cadastral survey drawing records only represent people’s needs for the unit with the authority to perform the measurement function – that is, a form of service, if you want to measure land. then the unit of measurement will satisfy, not the documents that show the origin of the land’s use.

In fact, in recent years, in many localities in Dong Nai province, there have continuously been situations where many people actively take cadastral measurements of land plots that do not belong to them and then sue in court, causing difficulties, Overburdening the judicial system in evaluating documents.

Currently, due to the failure of the local conciliation process, Mr. Day’s case has been guided by the Vinh An Town People’s Committee on the next steps to resolve.
