In 2023 alone, 15 new cases initiated by foreign countries with our country’s exported goods have arisen, in addition to many cases that are under investigation, or are subject to annual review or end-of-term review.

Among the countries that initiated investigations into Vietnamese goods last year, the United States was the country that initiated the most investigations with 7 cases, including 4 anti-dumping investigations (anti-dumping), 1 anti-subsidy investigation case (CTC) and 2 product scope/anti-trade tax evasion investigation cases (CLT).

The diverse items under investigation include products such as aluminum extrusions, aluminum cables, steel shelves, steel wheels, high pressure washers, paper bags, shrimp…

In addition, the US also reviewed a number of previously applied anti-trade measures, such as administrative review of CTC tax on tires, administrative review of anti-dumping tax on honey imported from Vietnam (including reviewing consider the issue of Vietnam’s market economy).

Overall, By the end of December 2023, the US had investigated 59 trade defense cases against Vietnamese export goods, accounting for nearly 25% of the total number of foreign cases investigating Vietnamese goods.

India is also the country that has conducted 31 trade remedy cases with Vietnamese goods. In 2023, India will continue to conduct new anti-dumping investigations on stainless steel welded pipes and review trade remedy measures on stainless steel welded pipes, copper pipes, and PVC plastic beads.

For the Canadian market, by the end of June 2023, this country had investigated 18 trade remedy cases with Vietnamese goods. NIn 2023, this country will not conduct a new investigation but will only conduct a review of some products that are subject to trade remedy measures.

Currently, Canada is applying taxes on 7 imported goods from Vietnam including: carbon welded steel pipes, cold rolled steel, concrete reinforced steel, copper pipe joints, anti-corrosion steel plates, cast oil pipes and upholstered seats.

Although the Mexican market has just accelerated exports by Vietnamese businesses since the CPTPP Agreement took effect, there have been a number of cases where Mexico initiated an investigation. Accordingly, Mexico has investigated 3 anti-dumping cases with Vietnam, including: galvanized steel (initiated in 2021), cold rolled steel (initiated in 2022) and welding wire (initiated in 2023).

Among ASEAN’s member partner countries, 4 countries use trade defense measures with Vietnam, including Malaysia, Indonesia and the Philippines and Thailand.

In particular, Malaysia has investigated 10 trade defense cases related to Vietnamese export goods. Since 2021, Malaysia has not initiated an investigation into a new case with Vietnam. Currently, Malaysia is applying trade defense measures to 7 Vietnamese products, mainly steel products.

Data up to the end of June 2023, Indonesia has investigated 14 trade defense cases related to Vietnamese export goods. The Philippines has investigated 14 trade defense cases related to Vietnamese export goods. Thailand has investigated 8 cases related to Vietnamese export goods, including 6 anti-dumping cases and 2 self-defense cases.

For the Northeast Asian market, as of June 2023, Korea has investigated and applied 4 anti-dumping measures on goods exported from Vietnam.

The Australian market has investigated 18 trade defense cases related to Vietnamese export goods.

Türkiye has investigated 26 trade defense cases related to Vietnamese export goods.

Pointing out the reason why exported goods are increasingly being sued for trade violations, the Ministry of Industry and Trade said that Vietnam is an open economy, has been participating in negotiations and signing many important FTAs, opening up opportunities. big for export. The rise of emerging commodity production centers like Vietnam with the strength of goods at affordable prices and meeting quality standards has made many import markets, especially some developed economies, develop the application of trade defense measures with greater frequency.

And yet, with the growth of export turnover in recent times, Vietnam’s export goods continue to face many cases of investigation against evasion of foreign trade defense measures.

In fact, cases tend to be investigated more rigorously, countries are tending to tighten, put forward higher requirements for governments and businesses being investigated, and apply trade defense measures. commercial. The nature of cases will also become increasingly complex and more difficult to respond and handle.
