Cases in which foreign organizations and individuals can own houses in Vietnam from 2025

Article 17 of the Housing Law 2023 (effective from January 1, 2025) regulates foreign organizations and individuals who can own housing and forms of housing ownership in Vietnam as follows:

1. Foreign organizations and individuals allowed to own houses in Vietnam include:

a) Foreign-invested economic organizations investing in housing construction projects in Vietnam according to the provisions of this law and other relevant laws;

b) Economic organizations with foreign investment capital, branches, representative offices of foreign enterprises, foreign investment funds and foreign bank branches operating in Vietnam (hereinafter collectively referred to as Foreign organization);

c) Foreign individuals are allowed to enter Vietnam.

2. Foreign organizations and individuals specified in Clause 1 of this Article may own housing in Vietnam, including apartments and individual houses through the following forms:

a) Organizations specified in Point a, Clause 1 of this Article may own housing through implementing housing construction investment projects in Vietnam;

b) Organizations and individuals specified in Points b and c, Clause 1 of this Article may own housing through purchasing, renting and purchasing commercial housing from investors of housing construction investment projects, or receiving gifts as gifts. , inheriting commercial housing in housing construction investment projects not in areas requiring national defense and security as prescribed in Article 16 of this law;

c) Organizations and individuals specified in Points b and c, Clause 1 of this Article may own housing through purchasing or renting housing from foreign organizations and individuals that already own houses as prescribed in Points 1 and 1 of this Article. b this clause.

Thus, from January 1, 2025, foreign organizations and individuals can own houses in Vietnam in the above cases.
