On April 24, Dong Nai Provincial Lawyers Association organized a conference to disseminate the Land Law 2024, the Housing Law 2023 and the Real Estate Business Law 2023 for over 100 delegates who are members and leaders of the Law Association. participating in districts, Bien Hoa city, Long Khanh city and departments, branches and units in Dong Nai province.

On this occasion, two individuals, lawyers from the Dong Nai Provincial Lawyers Association, were awarded Certificates of Merit by the Provincial People’s Committee for their many achievements in the law popularization movement in the province.

At the conference, the delegates were introduced to the highlights, new regulations, views on construction, inheritance and amendment by Dong Nai province’s legal rapporteur and Chairman of Dong Nai Lawyers Association, Phan Van Chau. , supplement of the Land Law 2024, Housing Law 2023 and Real Estate Business Law 2023 passed by the National Assembly.

Accordingly, the above three laws, once effective, will create a synchronous and unified legal corridor on land use rights, ownership of houses and structures attached to land during the process of conversion and transfer. , inheritance, donation, capital contribution…

In particular, the three laws mentioned above open up many opportunities in terms of ownership, transfer, and inheritance of real estate… for Vietnamese people residing abroad. Foreigners are allowed to enter Vietnam to live, work and invest.

At the Conference, the presenter clearly stated that the Law on Real Estate Business (amended) effective from January 1, 2025 does not allow subdivision and sale of plots in 105 cities and towns across the country.

Specifically, the law stipulates that it is not allowed to transfer land use rights to individuals who build their own houses, divide plots for sale in the areas of wards, districts, and cities of special grade, grade I, II, and urban areas. III and is in the case of auctioning land use rights to invest in housing construction projects according to the provisions of the Land Law.

According to statistics from the Ministry of Construction, by December 2023, the country will have 902 urban areas; Of which, there are 2 special type urban areas, 22 type I urban areas, 36 type II urban areas, 45 type III urban areas, 95 type IV urban areas and 702 type V urban areas.

Thus, according to the above regulations, there are 105 cities and towns that will not allow subdivision or sale of plots; an increase of 81 cities and towns compared to current regulations

Dong Nai province has 2 urban areas on the list: Bien Hoa city – a class I urban area under the province and Long Khanh city – a class III urban area under the province.

This regulation is said to contribute to “tightening” the activities of dividing plots and selling plots; Limit disruption to construction planning, architecture, and landscape of urban areas; At the same time, it helps the market develop more healthily.
