The Intellectual Property Strategy to 2030 has set the goal of increasing both the quantity and quality of new intellectual property of Vietnamese individuals and organizations.

On the occasion of World Intellectual Property Day April 26, a reporter from Vietnam News Agency (VNA) interviewed Mr. Le Huy Anh, Deputy Director, Department of Intellectual Property, Ministry of Science and Technology, about the award. measures to promote the application of inventions as well as orient the development of innovation activities in Vietnam to promote efficiency, serve the community, and promote socio-economic development in the coming time.

– From the practice of patent registration activities, can you tell us the benefits that patent registration activities bring?

Mr. Le Huy Anh: Registering for patent protection is an activity through which an invention is granted exclusive patent protection. To be protected by the State, an invention must meet protection conditions.

When a technical solution in the form of a product or process is protected, that is, a protection title is granted for a certain period of time, the rights holder has the exclusive right to use and exploit the protected object, the right to license it. or prohibit others from using and disposing such as giving, donating, or inheriting like other property rights.

Patent rights are the strongest type of intellectual property rights due to the exclusive nature they provide. In many cases where there is no alternative, entities around the world have invested a lot of money to register for patent protection.

Currently, governments and creative entities apply many measures to protect intellectual property for inventions, especially. Signing FTAs ​​(Free Trade Agreements) with high protection standards for inventions is also one of the measures for developed countries to protect this important type of property.

There are many benefits that patent registration can bring such as exclusivity. This is a very rare thing in a market economy and monopoly helps the right holder have exclusive production, business, price, and market monopoly, thereby surpassing competitors.

In addition, the benefits of enhancing the reputation of sovereignty, selling patent rights, blocking competitors, creating legal barriers to discourage competitors… are also benefits. that many researchers have mentioned.

– How do you assess the current status of patent filing activities and patent granting issues in Vietnam today?

Mr. Le Huy Anh: The Intellectual Property Strategy to 2030 sets the goal of increasing both the quantity and quality of new intellectual property of Vietnamese individuals and organizations, including the number of patent applications and protection certificates. Patent households increase on average 16-18%/year, the rate of commercially exploited inventions reaches 8-10% of patents granted protection certificates.

Recently, realizing the importance of inventions in socio-economic development based on science, technology and innovation, many provinces, cities, universities and research institutes research, large enterprises have policies to support and promote patent registration. This has helped the growth of patent applications by Vietnamese applicants in recent times have shown positive signs.

According to statistics of the National Office of Intellectual Property, the number of patent applications submitted to the National Office of Intellectual Property and the number of patents for inventions or utility solutions issued by the National Office of Intellectual Property in recent years There has been an increasing trend recently, even during the COVID-19 period.

In particular, in 2023, the number of invention patents and utility solution patents granted to Vietnamese applicants has more than doubled compared to 2022, including 315 patents, while 2022 is 153 degrees and 391 patents for useful solutions compared to 2022 which is 176 degrees.

Mr. Le Huy Anh: To promote the application of inventions in practice, many solutions need to be implemented synchronously, including the need to develop a network of technology transfer and intellectual property centers at research institutes, universities and businesses. industry to promote the creation and exploitation of intellectual property, especially inventions.

In addition, form a creative startup ecosystem in universities, encourage and support research institutes and universities to establish businesses to exploit intellectual property rights, shorten the application process. Apply research results to production and business.

The National Office of Intellectual Property also promotes the implementation of mechanisms and policies to develop industries with a high level of intellectual property use, create reputable and quality products, and promote the export of goods. has high intellectual property content.

At the same time, develop a healthy intellectual property market in the direction of expanding and improving the quality of intermediary services to strengthen the connection between supply and demand of intellectual property; Promote evaluation and valuation of intellectual property as a basis for conducting transactions on the market; Increase business participation in placing orders and solving applied research tasks based on business needs and suggestions.

To promote the rapid application of inventions in Vietnam, the National Office of Intellectual Property is effectively implementing programs to support small and medium-sized enterprises in exploiting intellectual property through invention commercialization activities.

The Department guides small and medium-sized enterprises or researches appropriate technologies from expired or unprotected patents in Vietnam to apply in production and business practices.

In particular, the participation of many different subjects is needed to connect supply – innovators and demand – businesses. Invention commercialization is the bridge that helps bring inventions to the market.

With the support of the World Intellectual Property Organization (WIPO), the Intellectual Property Office has presided over the establishment of the TISC Network (Technology and Innovation Support Centers).

As of March 2024, TISC Vietnam Network has 51 members, mostly universities, research institutes and some businesses.

The objective of the TISC Project of the World Intellectual Property Organization is to support access to high-quality scientific and technological information, patent information and related services; Assist in searching for patent information, developing and commercializing inventions.

Within the framework of the TISC Network, the National Office of Intellectual Property has implemented a series of activities to improve invention management and commercialization capacity for network member units.

In addition to increasing the number of protected inventions, Vietnam needs to focus on the criteria of commercializing inventions and applying inventions to life to bring value to the country, including innovation. approach, it is necessary to view intellectual property as a tool to protect, manage and develop product value, not just a goal, the end result is a protected product.
