Illegal land excavation case in Quang Tri: Consider handling in two options

Regarding the large-scale illegal excavation of land in Ben Ha village to level the ground for the Resettlement Area Project in Linh Truong commune, Gio Linh district, Quang Tri province that reporters reported, on April 24, Mr. Hoang Chien Cong, Director of the Project Management Board, Land Fund Development and Industrial Cluster of Gio Linh district, said the unit is considering two options.

Option 1, the owner of the plot of land that was illegally dug up – Mr. Nguyen Vinh, born in 1971, in Ben Ha village, Linh Truong commune – is administratively sanctioned and must return the land to its original state first. upon violation.

If Mr. Nguyen Vinh overcomes this by buying land of legal origin to return about 23,000 m3 of illegally dug land, then the corresponding amount of land used to level the project will be considered for acceptance.

Option 2 is not to accept the land price, the cost of ground leveling and transporting about 23,000 m3 of illegally excavated soil to level this project at a cost of nearly 3 billion VND.

Linh Truong commune resettlement area is a project serving site clearance for the Van Ninh-Cam Lo expressway project, period 2021-2025 with a scale of 3.38 hectares, approved by the People’s Committee of Quang Tri province. Approval decision in June 2023.

The Van Ninh-Cam Lo expressway project passing through the locality is invested by the People’s Committee of Gio Linh district. The Project Management Board, Land Fund Development and District Industrial Cluster is the Standing Agency of the Council for site clearance of this project.

According to Mr. Hoang Chien Cong, about 23,000m3 of illegally excavated land (located next to the project) was used by Nam Ben Hai Limited Liability Company (contractor) to build roadbeds and level the plots of the Commune Resettlement Area. Linh Truong.

Initially, this business argued that when buying land from the land supplier, this person must be responsible. According to regulations, “consuming illegal assets” is a violation of the law. Therefore, the business was aware that illegally buying land to level the resettlement area in Linh Truong commune was wrong. The extent of the violation must wait for the results of the police investigation.

Previously, in the last days of January, some subjects mobilized human resources and means to organize large-scale illegal land digging in Ben Ha village, Linh Truong commune.

Digging all the surrounding land and near some electric poles leads to the risk of the poles falling. Quang Tri Electricity Company was forced to erect new electric poles to ensure the safety of electricity transmission.

Immediately after the Vietnam News Agency reporter reported, Gio Linh district authorities took action. On February 1, Chairman of the People’s Committee of Gio Linh District Vo Dac Hoa signed Decision No. 08/QD-XPHC imposing an administrative fine of 45 million VND on Mr. Nguyen Vinh (born in 1971, in Ben Ha village). , Linh Truong commune) because of acts of destroying land and deforming the terrain with an area of ​​8,325 m2 in land plot No. 103, map sheet No. 48, Ben Ha village, Linh Truong commune.

Mr. Vinh is forced to restore the land to its original condition before the violation. In case of non-compliance, the State will reclaim the land according to regulations.

Previously, Mr. Nguyen Vinh had agreed with another person to lower the height of this plot of land and use the excess topsoil to sell. Mr. Nguyen Vinh admitted that lowering the height of this land plot was not authorized by the authorities and was a violation of the law./.
