Specifically, based on the content reported in Thanh Nien Newspaper on April 19, the Inspectorate of the Ministry of Construction requested the Department of Construction of Lam Dong province to specifically report in writing on the issues raised by the newspaper and report on the handling of the issues. Violations (if any) accompanied by documents on handling violations related to the above adjacent villa area.

The Department of Construction of Lam Dong province is responsible for reporting the above incident to the Inspectorate of the Ministry of Construction before May 3, to have a basis for reporting to the leaders of the Ministry of Construction.

Regarding this incident, Newspaper Youth reflected, the Lam Dong Department of Construction coordinated with the Department of Natural Resources and Environment, working with the People’s Committee of Bao Lam District, to determine that there are 17 villas to be built in Loc Thanh commune, Bao Lam district. Of these, 16 houses have basically completed the rough construction, and 1 house is under construction of the foundation and pillars.

Each apartment has 2 floors, foundation structure, reinforced concrete pillars, brick walls, concrete floors, tile roof. The area of ​​each apartment is from 106 – 135 m2floor area from 212 – 270 m2/can. In addition, there is also a prefabricated iron house temporarily built to store materials and temporary accommodation for workers serving the construction of the above villas.

According to the report of Bao Lam People’s Committee and Loc Thanh Commune People’s Committee, households building 17 villas on an area where the land use purpose has been changed are exempt from granting construction permits.

However, through comparing the construction area of ​​the 17 works mentioned above, it is consistent with the land use planning (it is residential land) but not in accordance with the approved construction planning in the area (not yet planned as a residential area). rural residence) so it does not ensure the regulations of the Housing law and Construction law.

Regarding this case, the People’s Committee of Lam Dong province also issued a written request to the People’s Committee of Bao Lam district to identify violations, prepare documents and procedures to handle administrative violations of construction. At the same time, organize a review and strictly handle the responsibilities of the leaders of the People’s Committee of Loc Thanh commune, relevant organizations and individuals in the state management of construction in the locality to prevent cases from occurring. mentioned above in accordance with regulations.

In order for the above violations to occur, Chairman of the People’s Committee H. Bao Lam signed decisions to temporarily suspend work for 15 days for Mr. Do Ngoc Can, Chairman of the People’s Committee of Loc Thanh commune, and Tran Ngoc Hoan, a cadastral civil servant. agriculture, construction and environment of Loc Thanh commune (currently the suspension period has ended – PV) to consider the responsibilities related to the construction of a series of villas in violation of the above planning.
