In particular, for the Doi Cu Da Lat Golf Course project, the Standing Committee of the Lam Dong Provincial Party Committee requested the authorities, based on the actual construction of the project, to rely on the legal basis according to regulations to deal with it thoroughly and do not cover up violations. When reviewing a project, it must be public, transparent, and absolutely ensure compliance with procedures and regulations. The Lam Dong Provincial Party Standing Committee requested the Provincial People’s Committee to report on implementation results before May 30, 2024.

This project was granted a construction license on January 12, 2023, the investor is Hoang Gia DL Joint Stock Company. Recently, this project was determined by the authorities of Lam Dong province that the investor had illegally built the licensed construction block with an area of ​​3,300 m2. In addition, the investor also built two other items without permission with a total violation area of ​​more than 20,400 square meters.

The government has made records and issued decisions to sanction administrative violations against businesses at the project for illegal and unauthorized construction, with a total fine of 240 million VND. Immediately after that, the investor stopped construction of the project from then until now.

In addition, the investor has strictly complied with the Decisions on sanctioning administrative violations, and at the same time, violations are not subject to dismantling the project. More specifically, the enterprise has paid a fine of more than 810 million VND and has carried out procedures for converting land use purposes and granting construction permits.

However, up to now, the Provincial People’s Committee has not received permission to change the land use purpose, which the Department of Natural Resources and Environment presented in Report No. 596/Tr-STNMT dated December 28, 2023. Therefore, the investor does not have enough documents to supplement the construction permit application, while the 90-day period has expired. The expiration of the 90-day period to complete the procedures is due to objective reasons that have not been considered and resolved by the competent authorities. Therefore, to allow enough time for the investor to complete the procedures, it is requested that the City People’s Committee. Da Lat considers extending the implementation time for investors according to its authority.

Regarding the conversion of land use purpose, the functional branches assigned the Department of Natural Resources and Environment to urgently complete a report to submit to the Provincial People’s Committee to change the land use purpose for an area of ​​5,835m2 so that the investor can complete the procedures. Construction procedures and the Department of Construction handle construction permits according to authority.

More than 30 years of project implementation

According to records and documents, the above project was granted Investment License No. 222/GP by the State Committee on Cooperation and Investment on August 8, 1991, allowing the establishment of DaLat Resort Incorporation Joint Venture Company (referred to as the Joint Venture Company). is DRI) to build and upgrade the 18-hole golf course (Cu Hill), 2 Palace and Da Lat hotels, 16 villas in Tran Hung Dao area, Palace I in the city. At the same time, the People’s Committee of Lam Dong province, based on the telegram of the Ministry of Construction dated April 23, 1992, issued Decision No. 244/QD-UB allowing DRI Company to bulldoze, plant grass and construct construction works. construction service process.

Next, on August 20, 1992, the Chairman of the Council of Ministers issued Decision No. 310-CT on the allocation of land to Lam Dong Tourism Company in joint venture with foreign countries to restore and upgrade the golf course, with accompanying drawings. By 1993, the Provincial People’s Committee approved a map of the total golf course area at a scale of 1/1,000 including the 18-hole course system and the Golf Club House construction area. At the same time, the project was approved by the Provincial People’s Committee. approved the environmental impact assessment report of the Golf Club in Decision No. 528/QD-UB dated May 27, 1996.

By 2016, the investor continued to deploy (phase 2) to invest in the construction of the Golf Club (Club House). Specifically, the investor invests in the construction of the Golf Club Building in accordance with the planning criteria and scale approved by the Provincial People’s Committee and the Investment Certificate is issued, ensuring orientation in the planning project. general (Decision 704 of the Prime Minister).

Accordingly, phase 2 of the project is the Golf Club Building consisting of 3 interconnected building blocks: reception block, golf service block 1, golf service block 2 with a total area of ​​6,120 m2 of total area. The area to implement phase 2 is 15,670 m2. The Golf Club building has been agreed upon by the Provincial People’s Committee with planning and architectural criteria for the project and the Provincial People’s Council has issued a Resolution to change the land use purpose of nearly 16,000 m2 to build the project’s construction items. … On that basis, the Department of Construction appraised the construction investment feasibility study report for golf service block 1, golf service block 2 and reception block, and was granted a Construction License for the underground part of the service block. golf 1.
