Specifically, for the application of Ms. Nguyen Thi Than, living in Village 11 (Loc Thanh commune, Bao Lam district), representing 26 households, submitted a request to Lam Dong Provincial People’s Committee to consider and approve the policy for Lam Tea Joint Stock Company. Co-implement the transfer of garden value and grant land use rights certificates (CNQSD) to contracted households. To resolve the application of Ms. Nguyen Thi Than representing the households, the Lam Dong Provincial People’s Committee reviewed the reports of the Lam Dong Provincial Inspectorate on the proposal to handle the applications of a number of households contracting land from the Lam Dong province. Lam Dong Joint Stock Company; At the same time, summarize the consensus opinions of relevant departments and branches at the working session on April 16, 2024 of the Provincial People’s Committee. On that basis, the People’s Committee of Lam Dong province considered that Ms. Nguyen Thi Than and 25 households submitted a request to be the person who has a garden contract with Lam Dong Tea Joint Stock Company. The contracting contract between households and Lam Dong Tea Joint Stock Company is a civil contract between the parties. Therefore, the parties shall comply with the signed Contract in accordance with the provisions of civil law.

Through review, it can be seen that the contracted land area of ​​households is not included in the plan and area approved by the Provincial People’s Committee to implement the project of transferring garden value and granting land use right certificates to households. contract. Therefore, the Provincial People’s Committee does not consider the application at the request of the households.

Similarly, in the case of the application of Ms. Nguyen Thi Hong Thuyet (residing in B’Lao ward, Bao Loc city) representing 8 households, requesting the People’s Committee of Lam Dong province to consider and approve the policy for the Company. Ngoc Bao Tea CP transfers the value of the garden.

Considering the reports of the Lam Dong Provincial Inspectorate and the unanimous opinions of the departments and branches at the meeting on April 16, 2024 of the Provincial People’s Committee, it shows that Ms. Nguyen Thi Hong Thuyet and the remaining 7 households are included in the application. The proposal is that the person has a garden contract with Ngoc Bao Tea Joint Stock Company and requests to transfer the garden. This is a civil contract between the parties, so the parties perform according to the Contract and civil law.

The contracted land area of ​​households is not part of the land area in the plan and area approved by Lam Dong Provincial People’s Committee to implement the project of transferring garden value and granting Land Use Rights Certificates to contracted households. On that basis, the Provincial People’s Committee did not consider the application at the request of the households.
