On April 25, the Hanoi People’s Court brought defendant Nguyen Song Hao (born 1969, in Dong Da) to trial for illegal possession of military weapons, prescribed in Clause 1, Article 304 of the Penal Code.
Mr. Nguyen Song Hao received a prison sentence for intentionally causing injury and property theft. The defendant was hired by someone else to dump dirt and waste into a number of residential houses in the block 16 Phan Dinh Phung, Hanoi twice on July 27, 2023 and August 12, 2023.
During the investigation of the above violation, on August 29, 2023, Ba Dinh District Police urgently searched Mr. Hao’s residence in Hoang Mai District and confiscated bullets and guns.
Among them, there were 100 bullets Mr. Hao bought online; 1 gun-like model and 2 bullets (1 bullet is 6.4 cm long, 1 bullet is about 3 cm long, Mr. Hao said he was given it by a social friend named Dung); 1 toy gun (Mr. Hao said he was given it by a friend named Thanh).
Investigation results showed that, around the end of 2020, Mr. Hao went online to learn about guns and ammunition and bought materials to assemble into guns. But when I bought it and tried to assemble it, it was not successful.
The Hanoi People’s Procuracy determined enough grounds to conclude that around 2020, defendant Nguyen Song Hao bought and hid in his private home a 3cm long bullet, size 11.43×23 mm, used for Colt pistols, which are military weapons for the purpose of purpose for self-defense.
Mr. Hao’s above actions were sentenced by the jury to 12 months in prison.
With the subjects named Dung and Thanh, who gave Mr. Hao guns and bullets as well as the website where the defendant ordered 100 bullets, because Mr. Hao could not clearly declare his identity, background, and did not remember the website address, so The investigation agency has no basis for verification.
The allegation is that the act of possessing 1 bullet 6.4 cm long is a 32 caliber bullet, belonging to a weapon with similar effects to a hunting rifle and 100 bullets both 2.5 cm long belong to a sporting weapon. of Mr. Hao violated regulations on management of weapons with similar features to hunting guns and sporting weapons.
The act does not constitute the crime of illegal possession and use of hunting guns and sporting weapons specified in Article 306 of the Penal Code, so the Hanoi Police Security Investigation Agency has transferred related documents to Ba Dinh District Police for investigation. Consider administrative handling of Mr. Nguyen Song Hao according to regulations.
