(PLVN) – On the afternoon of April 25, 2024 in Ho Chi Minh City, within the framework of the International Construction Arbitration Conference in Ho Chi Minh City. Ho Chi Minh – HICAC 2024, Vietnam International Arbitration Center (VIAC) and Dubai International Arbitration Center (DIAC) have signed a Memorandum of Cooperation.

VIAC and DIAC share the goal of promoting the development of dispute resolution methods by arbitration, conciliation or other dispute resolution methods in accordance with the law in a friendly and fair manner. , conveniently and quickly, contributing to improving the competitiveness of the economy and business community, promoting economic, trade, investment, science and technology cooperation between organizations and individuals at home and abroad.

Ms. Jehad Kazim – Director of Dubai International Arbitration Center (DIAC) spoke at the signing ceremony.

Accordingly, the two sides commit to working together to promote the development of commercial dispute resolution methods, through commercial arbitration as well as other dispute resolution (ADR) methods. The agreement is expected to take another step forward in strengthening economic and investment relations between Vietnamese businesses and Dubai as well as the United Arab Emirates and other countries.

After the signing ceremony, there was a discussion on the topic “Interference between Legal Traditions in International Arbitration”. The event was coordinated by the Vietnam International Arbitration Center, with the participation of more than 80 domestic and international delegates.

According to experts, the field of International Arbitration always exists at the intersection of diverse legal systems. In fact, it is increasingly common for disputes involving parties and Arbitrators from different legal traditions. Consider the difference in the law chosen to govern, from the arbitration agreement to the arbitration award. The intersection between Eastern and Western legal systems in international arbitration has been posing challenges but also opportunities in working towards the fair and effective operation of arbitration proceedings. .

Experts moderate the discussion session

At the conference, speakers discussed “The interaction of governing legal systems in an international arbitration proceeding and implications for choice of law.” Practical challenges of governing legal systems in international arbitration procedures and some notes in choosing the law applicable to arbitration agreements are pointed out by experts. In addition, the workshop also clarified the legal systems governing international arbitration procedures.
