On April 23, 2024, Mr. Huynh Tan An, Director of Real Estate Investment and Trading Joint Stock Company (abbreviated name: Becamex Real) had a working session with LMM customers. At the working session, Becamex Real representative said that they will refund the amount of 1.7 billion VND to LMM customers.

The customer will hand over the original contract and documents to Becamex Real. After Becamex Real refunds money to customers, this business has full authority to do business with World Dat Viet Investment and Development Joint Stock Company, customers no longer have related rights and obligations. At the same time, customers must withdraw their petition and send it to the Department of Construction, Inspectorate of the Ministry of Construction, and People’s Committee of Binh Duong province as committed.

On April 25, customers LM M and Becamex Real signed a minutes based on the contents agreed on April 23. Customer LM M was refunded by Mr. Huynh Tan An with the content “refund box 100 lot F132”, and at the same time the customer withdrew his petition to resolve the conflict.

The location of the land advertised is the Elite Town Urban Area project, part of the 5F Residential Area project, hamlet 5, Lai Uyen town, Bau Bang district.

Regarding this, as Reatimes informed, previously, LMM customers have submitted a petition to the Department of Construction of Binh Duong provincePeople’s Committee of Binh Duong province, Inspectorate of the Ministry of Construction on the inspection of capital mobilization at the 5F Residential Area project, invested by Becamex IDC Corp, in Hamlet 5, Lai Uyen town, Bau Bang district, Binh Duong province.

The customer reported that around December 2022, via social networks, he was introduced to the Elite Town Urban Area project by a sales staff of Dat Viet World Investment and Development Joint Stock Company. Residential Area 5F project, Hamlet 5, Lai Uyen town, Bau Bang district, Binh Duong province.

This employee said that this is a project invested by Real Estate Investment and Trading Joint Stock Company (abbreviated name: Becamex Real). The project to divide lots and sell plots, has full legality and potential, complete infrastructure, is completing procedures to issue separate books for each plot, it is expected that in the next 12 months, registration will be issued to customers. purchase this project. This project has a total of 104 plots of land.

At the request of the customer, the staff provided images of the land use rights certificates of these 104 plots of land, which are land plots number 191 and 192, map sheet number 45, noted as block F132, Residential Area 5F issued by the Department of Natural Resources and Environment of Binh Duong province on August 21, 2018. However, this certificate was issued to allocate land to the Industrial Development and Investment Corporation – Joint Stock Company (Becamex IDC Corp). The staff explained that Becamex Real is a subsidiary of Becamex IDC Corp. Because it is a subsidiary, Becamex IDC Corp was assigned to be the investor.

Trusting the staff’s advice, on December 24, 2022, the customer transferred a deposit of 50 million to the account number of Mr. Huynh Duc, General Director of Dat Viet World Investment and Development Joint Stock Company. to buy plot number 100 of the project with a transfer price of more than 1.8 billion VND. The staff said that this is the price listed by the investor – Becamex Real Company.

On February 25, 2023, the customer signed a land use rights transfer agreement with Viet Dat World Company. At the time of signing the agreement, the customer transferred the first payment according to the agreement with a total amount of 1 billion VND to the account clearly stated in the agreement, which is Mr. Huynh Duc’s personal account. The main content of the agreement clearly states: after paying 95% of the transfer price, the customer will sign a principle contract on land use rights transfer with the investor.

On April 23, 2023 and June 1, 2023, customers continued to transfer money to the above account to make the second payment of a total amount of more than 750 million VND. Thus, the customer has transferred a total of 1.8 billion VND, 95% of the transfer price, so he is eligible to sign a principle contract with the investor.

On June 2, 2023, the staff asked the customer to sign a principle contract with Becamex Real, with the content: agreement to transfer the above land plot for an amount of 1.2 billion VND. The remaining amount of more than 600 million will sign a consulting service contract with The Gioi Dat Viet. Along with asking the customer to sign the above two contracts in advance, the staff asked the customer to return the agreement both parties had signed for them to revoke. However, the customer did not agree and requested to liquidate the agreement in writing.

After that, customers discovered that Becamex Real is not a subsidiary of Becamex IDC Corp. On the consulting service contract, The Gioi Dat Viet also stated the terms: as soon as the principle contract is signed with Becamex Real, The Gioi Dat Viet no longer has any obligations and responsibilities to the customer.

Next, through The Gioi Dat Viet staff, the customer discovered that Becamex IDC had signed a principle contract to agree to transfer the entire lot F132 of the 5F residential area project to an individual named Huynh Lam. Mr. Huynh Lam then signed a brokerage service contract and authorization contract for Becamex Real Company.

“So, according to these documents, Becamex Real is only a brokerage company and authorized representative of an individual who has an agreement with the investor, but Viet Dat World Company deceived me that Becamex Real is investor and concealed Mr. Huynh Lam’s presence and role in the transfer relationship,” the customer reflected.

From this reality, LMM customer has submitted a request to the Department of Construction of Binh Duong province to perform the function of inspecting and checking the capital mobilization and legal basis of transactions of Becamex IDC Corp, Mr. Huynh Lam, Becamex Real Estate, Nam Phat Real Estate, Viet Dat World and handle according to legal regulations.

At the same time, customers request to provide the following information:

Firstly, is Becamex IDC Corp’s capital mobilization through the principle contract signed with Mr. Huynh Lam in accordance with the provisions of the Housing Law, Real Estate Business Law and related regulations?

Second, contracts and agreements (Huynh Lam real estate brokerage service contract – Becamex Real; Becamex Real authorization contract – Nam Phat Real Estate Construction Joint Stock Company, dated June 9, 2022; Paper Authorization 01/2022 Nam Phat Real Estate Construction Joint Stock Company – World Dat Viet dated June 16, 2022 and Authorization Appendix; Land use rights transfer agreement dated February 25, 2023 World Dat Viet – Does LMM) ensure the provisions of the Housing Law, Real Estate Business Law, Land Law and related regulations?/.
