Out of control car crashed into a gas pump in Dong Thap

Recently, a video of a “crazy car” losing control in Dong Thap was posted on social networks, causing a stir in public opinion.

According to the camera recorded by a petroleum enterprise in cluster 3, ward 6, Cao Lanh city, Dong Thap province, at about 7:38 a.m. on April 26, a 4-seater car suddenly drove straight after refueling. forward, turn around and face the main road, then turn around and go back to the gas station. At this point, the gas attendant had just left a few steps.

This car continued to repeatedly crash into two motorbikes that were stopping to refuel. The collision caused one person to be thrown away, while another person ran away in time and was not injured.

After that, the car continued to knock down the gas pump and crashed into the cement column next to it before stopping.

According to the authorities, the cause of the incident was determined to be because after refueling, the car’s brakes were stuck. The driver then continued to remove the handbrake but the car did not stop and instead rotated many times.

The incident left one resident with minor injuries. Currently, the case is being received and handled by Cao Lanh City Police according to regulations. It is estimated that the damage from this accident is about 70 million VND.

What fines can car drivers face?

In this incident, the authorities will determine the cause of this accident, who is at fault; conduct scene examination; extract camera data around the accident; Take testimonies from witnesses and related people, assess the injury rate of the victims, evaluate damaged property… To have a basis to handle the case according to the law.

Regarding civil liability, the 2015 Civil Code stipulates that any person who, through intentional or unintentional error, violates life, health, honor, dignity, reputation, property, rights, and legitimate interests other individuals, violate the honor, reputation, property of legal entities or other entities and cause damage, compensation must be made.

Therefore, the person causing the accident must compensate the victims when they file a claim for costs of property damage, health treatment, mental damage, etc.

If there are enough signs to constitute a crime, the driver who caused the accident may be prosecuted for criminal liability for the crime of “Violating regulations on road traffic participation” according to Article 260 of the 2015 Revised Penal Code.

Accordingly, anyone participating in road traffic who violates regulations on road traffic safety causing damage to others falls into one of the following cases: Causing death; Causing injury or harm to the health of a person with a bodily injury rate of 61% or higher; Causing injury or harm to the health of 2 or more people with a total bodily injury rate of 61-121%; Causing property damage from 100 to less than 500 million VND will be subject to a fine of 30-100 million VND, non-custodial reform for up to 3 years or imprisonment from 1-5 years.

In addition, the offender may also be banned from holding certain positions, practicing certain professions or doing certain jobs for 1-5 years.
