Specifically, the above amended and supplemented decision clearly states: “Forced to maintain the current land use status as at the time of discovering the violation and must carry out land-related procedures according to regulations within 30 days ( working) for an area of ​​2,261.58m2”.

In case of failure to carry out land procedures as prescribed, the city will apply Point a, Clause 4, Article 11 of Decree No. 91/2019/ND-CP dated November 19, 2019 of the Government regulating Penalties for land-related administrative violations require restoration of the original condition of the land before the violation.

Through inspection, the authorities said that this project violates construction on aquaculture land. Both of these land plots are not eligible to change the use purpose from aquaculture land to rural residential land, because they do not conform to construction planning.

Therefore, on January 9, 2023, the Chairman of the City People’s Committee issued Decision No. 82/QD- XPHC on sanctioning administrative violations against Mr. Xi. Accordingly, the fine is 22.5 million VND and the remedial measure is to restore the original condition of the land before the violation.

However, through comparing the regulations, the City People’s Committee concluded that in case Mr. Xi’s land location has built a project, procedures for changing the land use purpose must be established according to regulations. The Chairman of the City People’s Committee issued a decision to amend and supplement part of the previous decision on sanctioning administrative violations.
