However, recently on April 21, Mr. Pham Thai Ha, Deputy Head of the National Assembly Office, Assistant to Mr. Hue was arrested and prosecuted for the crime of “Abusing his position and power to influence others for profit” related to the Thuan An Group case.

About a month ago, former President Vo Van Thuong was also dismissed. At that time, Mr. Hue was one of the few Politburo members qualified according to Regulation 214-QD/TW for the position of president.

But more than a month later, Mr. Hue also “followed” Mr. Thuong by “resigning” his positions. The 13th Politburo initially had 18 people. Now, with the departure of Mr. Hue, this number is only 13.

Reason for resignation?

The arrest and prosecution of Mr. Pham Thai Ha, Mr. Hue’s close assistant, may be one of the reasons why Mr. Hue had to “please stop”.

First, it is necessary to talk about the relationship between Mr. Hue and Mr. Ha – who is said to be Mr. Hue’s confidant.

Before working as assistant to Mr. Vuong Dinh Hue at the National Assembly, Mr. Pham Thai Ha followed Mr. Hue through many agencies.

According to the above information from VOV, while Mr. Vuong Dinh Hue was the State Auditor General from 2006 to 2011, Mr. Pham Thai Ha was his assistant.

After that, when Mr. Hue held important positions such as Minister of Finance in the period 2011-2012, Head of the Central Economic Commission in the period 2012-2016, Deputy Prime Minister in the period 2016-2020, Mr. Pham Thai Ha still is Mr. Hue’s close assistant.

Even when Mr. Vuong Dinh Hue moved to become Secretary of the Hanoi Party Committee (2020-2021), Mr. Pham Thai Ha still followed in his footsteps.

By April 2021, Mr. Hue became Chairman of the National Assembly, one of Vietnam’s “Four Pillars”. Mr. Ha also moved to become assistant to the Chairman of the National Assembly.

And just over a year later, in May 2022, Mr. Pham Thai Ha was officially appointed as Deputy Head of the National Assembly Office.

Thus, the close relationship between Mr. Vuong Dinh Hue and Mr. Pham Thai Ha is very clear.

If according to Regulation No. 41-QD/TW of the Politburo on dismissal and resignation of officials, Mr. Vuong Dinh Hue could have been punished for Mr. Pham Thai Ha’s violations.

Article 7 of this regulation clearly states:

1. Dismissal of the head when allowing the agency or unit under his/her management, responsibility or direct subordinates to experience very serious corruption or negativity.

2. The leader who abuses his position and assigned powers to tolerate, cover up, and abet corruption and negativity will be considered for resignation depending on the nature and extent of the violation.

3. Resign the head when the agency or unit under his/her management, responsibility or direct subordinates has serious corruption or negativity.

Lawyer Phung Thanh Son, Director of World Law Law Firm, analyzed with the BBC that, in essence, the crime of “Abusing position and power to influence others for personal gain” for which Mr. The indictment is a crime that belongs to the group of corruption crimes.

“Therefore, based on Clause 1, Article 7, Regulation 41-QD/TW dated November 3, 2021 of the Politburo, it is necessary to dismiss the head when leaving agencies and units under his/her management and charge. or the direct subordinates have serious corruption or negativity, then they are eligible to consider dismissing Mr. Vuong Dinh Hue,” the lawyer assessed.

According to Lawyer Phung Thanh Son, even if it is assumed that the crime that Mr. Ha was prosecuted for is not a crime in the group of corruption crimes, it is still eligible to consider dismissing Mr. Vuong Dinh Hue.

Because Clause 1, Article 7 does not stipulate that corruption and very serious negativity must occur at the same time to be considered for dismissal.

For the crime of “Abusing position and power to influence others for personal gain”, the penalty range is up to life imprisonment, which can be considered “especially serious”, according to Attorney Son.

The penalty for this crime is up to life imprisonment, so according to regulations, this is a “especially serious” crime.

Thus, it is possible that Mr. Hue resigned because he was responsible for the mistakes of his subordinate, Mr. Pham Thai Ha.

Precedents of ‘responsibility of the leader’

Before Mr. Vuong Dinh Hue, there were a series of high-ranking officials in Vietnam who resigned for the reason of “head responsibility”.

On March 20, Mr. Vo Van Thuong resigned from holding positions in the party and state because of “violations and shortcomings that caused bad public opinion, affecting the reputation of the Party, State and individuals.” grandfather”.

Mr. Nguyen Quang Linh was appointed assistant to Deputy Prime Minister Pham Binh Minh for nearly 10 years, from December 31, 2013 until his arrest. In April 2023, Mr. Linh was sentenced to 7 years in prison.

The time of prosecution and sentencing of Mr. Nguyen Quang Linh occurred after the time of Mr. Pham Binh Minh’s dismissal (January 2023).

However, immediately after Mr. Linh was prosecuted and detained on the charge of “receiving bribes”, which is one of the crimes belonging to the group of corruption crimes, the Party was able to raise the issue of human responsibility. Head out to take a look.

Mr. Vuong Dinh Hue’s career

Mr. Vuong Dinh Hue was born in 1957 in Nghi Xuan commune, Nghi Loc district, Nghe An province. He is a member of the 12th and 13th Politburo and Chairman of the 13th National Assembly from July 20, 2021.

He has an academic title, Professor, Doctor of Economics, and PhD student at Bratislava University of Economics, Slovak Republic.

He was a lecturer, then Deputy Dean, Dean of the Faculty of Accounting, then Vice Principal of Hanoi University of Finance and Accounting.

From 2001 to 2013, Mr. Hue held positions such as Deputy Auditor General, State Auditor General, and Minister of Finance.

Mr. Hue was Head of the Central Economic Commission for the period 2012 – 2016.

At the 12th Party Congress in January 2016, he was elected to the Politburo, the group of Vietnam’s most powerful figures.

Then, in April 2016, Mr. Vuong Dinh Hue became Deputy Prime Minister under Prime Minister Nguyen Xuan Phuc.

In February 2020, when Mr. Hoang Trung Hai was disciplined, the Politburo appointed Mr. Hue as Secretary of the Hanoi Party Committee.

At the 13th Party Congress, Mr. Hue continued to join the Central Executive Committee and the 13th Politburo.

On March 31, 2021, Mr. Vuong Dinh Hue officially became the new Chairman of the National Assembly and Chairman of the National Election Council, replacing Ms. Nguyen Thi Kim Ngan.

As Chairman of the National Assembly

Mr. Hue’s recent outstanding activity is a five-day trip to China, from April 7 to April 12.
