Cao Bang City People’s Court conducted mobile trials of 02 cases on illegal possession of narcotics

Defendant Phan Khanh Son

First case: At 0:30 a.m., December 27, 2023, in the area of ​​Nam Phong 1 hamlet, Hung Dao commune, Cao Bang city, the Hung Dao Commune Police Working Group arrested Phan Khanh Son red-handed. Born in 2000, residing in Nam Phong 1 hamlet, Hung Dao commune, had the act of possessing 1.04 grams of Methamphetamine type drugs for the purpose of personal use.

During the investigation, Phan Khanh Son declared: At about 8:00 p.m. on December 25, 2023, Son alone walked from home to the Cao Bang City Bus Station area in De Tham ward, Cao Bang city to buy drugs. for personal use. Here, I met an unknown man who looked like an addict and asked to buy drugs for 1.6 million VND. This man received the money and then gave Son 2 transparent plastic packages with claw locks inside containing methamphetamine. After buying the drugs, Son hid two packages of drugs in his coat pocket and hung the coat in the bedroom. At about 0:10 a.m. on December 27, 2023, Phan Khanh Son put on a shirt and took two packages of drugs out of the house to find a place to use them. On the way, Son was discovered by the police, caught red-handed and confiscated all evidence as stated above.

Defendant Doan Dam Trong

Second case: At 1:30 p.m., January 9, 2024 in the area of ​​Group 03, Hop Giang ward, Cao Bang city, the Police Working Group of Hop Giang ward, Cao Bang city caught Doan Dam Trong red-handed , born in 1977, residing in Ngoc Quyen hamlet, Hung Dao commune, Cao Bang city, had the act of possessing 0.12 Heroine type drugs for the purpose of personal use.

The investigation process determined: At about 1:00 p.m. on January 9, 2024, Doan Dam Trong alone drove a motorbike with license plate number 11X1-024.15 from his home to the area at the beginning of Pho Cu street, Hop Giang ward. Here, Trong met an unknown man and asked to buy drugs for 200,000 VND. This man agreed, took the money, took it out from his body and gave Trong a package of drugs in yellow foil. After the exchange, it was unclear where this man went. Trong put the drug package in the front right pocket of the shirt he was wearing and then drove the car to find a place to use it. When he went to the area of ​​Group 03, Hop Giang ward, Cao Bang city, he was discovered by the police, caught red-handed and confiscated all evidence as mentioned above.

During the investigation process, both defendants Phan Khanh Son and Doan Dam Trong confessed honestly, so they were entitled to mitigating circumstances of criminal liability prescribed in Point s, Clause 1, Article 51 of the Penal Code.

Pursuant to Point c, Clause 1, Article 249 of the Penal Code, the Trial Council of the People’s Court of Cao Bang City sentenced defendant Phan Khanh Son to 22 months in prison; Defendant Doan Dam Trong was sentenced to 13 months in prison.
