Reviewing a number of bidding packages implemented by the Department of Transport of Phu Tho province with a budget capital of up to hundreds of billions of VND, but through bidding activities, selecting contractors only reduces budget investment capital. Poor numbers and the situation of winning bidders at close prices are still continuing and have become a “chorus” at this unit.

Regarding the above situation, lawyer Diep Nang Binh, Ho Chi Minh City Bar Association, said that according to the provisions of the Bidding Law and related documents, there are no regulations requiring the savings rate to be within a certain limit, even if the savings rate is 0, it is not a violation because the law does not regulate it. According to the principle of determining the lowest price for bidding cases applying the lowest price method, of course the contractor who offers the lowest price among qualified contractors will be selected.

“However, the phenomenon of having too many bidding packages with low savings rates or some contractors being “familiar” with the bidding party is not normal, the person responsible will be the head of the unit,” the law said. Master Binh emphasized.

According to bidding experts, the purpose of bidding activities is to find qualified contractors and at the same time save maximum investment capital, especially the State budget. The situation of winning bids at close prices at the Department of Transport of Phu Tho province requires close inspection and supervision by law enforcement agencies.
