Prosecuting the case of illegal construction of 680 villas and townhouses in Dong Nai

On May 29, the Investigation Police Agency, Dong Nai Provincial Police decided to prosecute a criminal case to investigate the crime of abusing positions and powers while on official duty, which occurred at the Project. Tan Thinh residential area invested by LDG Joint Stock Company, in Doi 61 commune, Trang Bom district (Dong Nai).

Previously, the conclusion of the comprehensive inspection of the Tan Thinh residential area project by the Chairman of the Dong Nai People’s Committee determined that, by the time of the inspection, LDG Joint Stock Company had not been assigned by the competent State agency. land, lease land, permit change of land use purpose and have not yet been granted a construction permit to carry out investment in project construction.

However, the company has organized construction works from 2018 to 2020, including: 680 houses, of which, 198 villas, 290 townhouses have been completed; 192 townhouses are under construction. In addition, this company has constructed the system of roads, water supply and drainage, electricity, wastewater treatment in green parks.

Concluding the inspection, the Land Registration Office of Dong Nai province confirmed on the certificate of land use rights with the content “Transferred to LDG Investment Joint Stock Company” with an area of ​​16,094m2, of which 12,889 m2 of rice land, without a written approval from a competent state agency for economic organizations that receive the transfer, capital contribution, or lease of agricultural land use rights to implement the project, it is not in accordance with regulations Clause 1, Article 193, 2013 Land Law.

This behavior is criminal. The responsibility belongs to the Provincial Land Registry Office, the former leader of this unit and related organizations and individuals.

The inspection conclusion also clearly shows the responsibility of 13 organizations and more than 20 individuals related to violations at the project and proposes handling methods.

In particular, the behavior of Mr. Hoang Van Dung, former director of the Land Registration Office of Dong Nai province, related to signing and certifying on the certificate of land use rights, was asked to transfer the investigation agency to clarify the signs. criminal.

Violations at Tan Thinh Residential Area Project are one of three cases added to the category of the Central Steering Committee on anti-corruption, negatively monitoring and directing.
