On April 24, after more than a day of trial, representatives of the Ho Chi Minh City People’s Procuracy impeached defendants Tran Qui Thanh, Tran Uyen Phuong, and Tran Ngoc Bich.
The prosecution recommended defendant Tran Qui Thanh 9-10 years in prison, Tran Uyen Phuong 5-6 years in prison, and Tran Ngoc Bich 4-5 years in prison.
According to the Procuracy, defendant Tran Qui Thanh was the one who directly worked, discussed with the borrower, broker and then informed his two children, Tran Uyen Phuong and Tran Ngoc Bich, so he must bear the main responsibility; Next in charge are Tran Uyen Phuong and Tran Ngoc Bich.

The defendants concealed the loan by signing a capital contribution contract; There are changes in name changes, transfers, and even lawsuits in court. When the victim prepared enough money, the defendant used the excuse of not returning the property.
According to the Procuracy, at the trial, through questioning, the defendants were aware of their actions and honestly confessed, so the Procuracy asked the jury to consider them when assessing the sentence.
The defendants have extenuating circumstances: creating many jobs for workers, contributing to the local economic society, preventing the Covid-19 epidemic and overcoming the consequences of 185 billion VND… The defendants There is an aggravating circumstance of committing the crime twice or more. The Procuracy requested the jury to consider aggravation or mitigation, corresponding to each defendant’s behavior to consider the appropriate sentence.
In court, defendant Thanh and his two daughters admitted the content as stated in the indictment. The defendants, through brokers, lent money to the four victims and asked the property and project owners to sign property transfer contracts to them. Later, when the victim requested to redeem his property, the defendants did not agree.

From January 2019 to November 2020, Mr. Tran Qui Thanh and his girlfriends committed 4 acts of Abuse of Trust to appropriate the property of 4 victims, with a total value of more than 1,048 billion VND.
According to the prosecution, the loan is without a loan contract with property pledged. The defendants accused businesses and individuals who borrowed money to make contracts to transfer projects, shares in projects, and real estate with values much lower than the actual value.
When the borrower was confused and worried about this, the defendants provided information to create confidence about their reputation and financial potential, signed “resale commitments”, and paid legal loan interest in the form of deposit receipts. deposit to buy back a project or real estate, promising to fully pay the principal and interest and return the property.
After the asset owner (borrower) completed the procedures to transfer the assets to Tran Uyen Phuong, Tran Ngoc Bich quickly completed the procedures to transfer the name to take control and dispose of the assets. Authorities determined that Bich’s above behavior was following his father’s instructions.
When the borrower fully fulfilled its obligation to repay principal and interest as agreed, the defendants used deceitful tricks or created reasons to intentionally not pay and appropriate assets.
