In 2021, many cars of residents living in Trung Van urban area (Trung Van Ward, Nam Tu Liem District) were also splashed with paint when parked on the internal road area. Similarly, during the above period, dozens of people’s cars in TT19 area (Phuc La Ward, Ha Dong District) parked in front of houses were spray-painted by strangers, causing property damage. .

The act of splashing paint on cars not only causes property damage to the car owner, but also causes frustration and concern for people about the security and order situation. So, how can this behavior be handled?

May be subject to administrative or even criminal sanctions

Lawyer Ha Cong Tam, Hanoi Bar Association, said that splashing paint on someone else’s car is a sign of destruction or intentional damage to someone else’s property.

According to the provisions of Point a, Clause 2, Article 15 of Decree 144/2021, acts of destroying or intentionally damaging property of individuals or organizations will be fined from 3 – 5 million VND.

In cases where the value of the property destroyed is sufficient to constitute a crime, the person committing the act may be prosecuted for criminal liability for destroying or intentionally damaging property, according to the provisions of Article 178 of the Code. Criminal law.

In particular, any person who destroys or intentionally damages another person’s property worth from 2 million VND to under 50 million VND or under 2 million VND but falls into one of the following cases: has violated an administrative penalty. Violations that adversely affect security and order… will be fined from 10 – 50 million VND, non-custodial reform for up to 3 years or imprisonment from 6 months to 3 years.

If the crime causes damage to property worth from 50 million VND to less than 200 million VND, the penalty shall be from 2 to 7 years in prison; Committing a crime that causes damage to property worth from 200 million VND to less than 500 million VND, shall be sentenced to 5 – 10 years of imprisonment; Committing the crime of causing damage to property worth 500 million VND or more, shall be sentenced to 10 – 20 years in prison.

In addition, offenders may also be fined from 10 – 100 million VND, banned from holding positions, practicing certain professions or doing certain jobs for 1 – 5 years.

Is parking blocking the house’s door a violation?

In some cases of splashing paint, graffiti or flat tires, the cause comes from the car driver parking in front of a house or store. The homeowner or store owner believes that parking causes obstructions and should take the actions listed. Is it illegal for the driver to park like that?

Lawyer Ha Cong Tam cited Decree 100/2019 (amended and supplemented by Decree 123/2021) stipulating a number of fines related to stopping and parking in improper places.

In particular, a fine of 400,000 – 600,000 VND will be imposed on car drivers who stop or park not close to the right edge of the road in the direction of travel where the road has a narrow sidewalk or no sidewalk; stopping or parking against the direction of traffic; stop or park on a fixed median strip between two sections of the road…

Or fine from 800,000 – 1 million VND for parking not close to the curb or sidewalk on the right side in the direction of travel or the nearest wheel is more than 0.25 m from the curb or sidewalk; Parking on tramways and bus routes; Parking on drainage manholes, tunnel openings of telephone lines, high voltage electricity, and spaces reserved for fire trucks to get water; Parking or parking on the sidewalk against the law; Parking where there are no parking signs…

Thus, there are many cases of parking in the wrong places that will be fined, but this does not include parking blocking people’s houses or businesses. In other words, if a driver parks his car in front of a house or business, without violating one of the acts stated in Decree 100/2019, he will not be fined.

In case a car is parked in front of a house or store, the homeowner or store owner should calmly contact the car owner to ask them to drive the car somewhere else.

If the car owner refuses to drive the car away, intentionally leaves it in the same place, or cannot contact the car owner, the homeowner or store owner can contact the local police to request assistance in handling the matter.

In case of splashing paint, destroying or causing damage to the vehicle, depending on the behavior and nature and extent of the cause, the person doing it may be subject to sanctions as stated above.
