Among them, defendant Duong Hoa Xo, former Director of the CNSN Center under the Department of Agriculture and Rural Development of Ho Chi Minh City, was proposed to be prosecuted for bribery. Ms. Nguyen Thi Thanh Nhan and two other defendants were proposed to be prosecuted for bribery.

Two defendants, Tran Thi Binh Minh, former Deputy Director, and Phan Tat Thang, former Deputy Head of the Economic Department, Department of Planning and Investment of Ho Chi Minh City, were proposed to be prosecuted for abusing their positions and powers while performing official duties.

There are 8 defendants proposed to be prosecuted for violating bidding regulations causing serious consequences.

According to the investigation results, the Biotechnology Center belongs to the Department of Agriculture and Rural Development of Ho Chi Minh City, with Mr. Duong Hoa Xo as director from 2004 to 2020. The Biotechnology Center implemented a project to purchase equipment for 12 laboratories with The cost is 425 billion VND.

In April 2014, Ms. Nguyen Thi Thanh Nhan was a guest at the inauguration ceremony of the tissue culture area of ​​the Biotechnology Center. Here, Ms. Nhan met Mr. Duong Hoa Xo.

After learning that the Biotechnology Center was implementing a 12-laboratory project, Ms. Nguyen Thi Thanh Nhan directly contacted and agreed with Mr. Duong Hoa Xo to let AIC Company win the bid to carry out 10 packages of project 12. Laboratory of the Biotechnology Center.

With the “nod” from the former Director of the Biotechnology Center, Ms. Nhan assigned her subordinates to contact the Biotechnology Center staff to build a list of equipment in the direction of raising prices to ensure AIC Company’s profit is 40%. bidding package value.

After that, these individuals colluded with Hong Ha Consulting Company to advise on preparing bidding documents in favor of AIC Company or a company designated by AIC.

From there, helping AIC Company and Mopha Company (belonging to the AIC ecosystem) win 6 bidding packages and companies designated by AIC including Gene Viet Company, Viet A Company, Vimedimex Company win 3 bidding packages.

As for bidding package No. 1, phase 1, AIC must enter into a joint venture with NEAD Company to ensure capacity and win the bid. This bidding package is implemented by NEAD Company and earns profits, without colluding with AIC and the investor to increase the price of the bidding package.

The investigation agency determined that Ms. Nguyen Thi Thanh Nhan, Mr. Duong Hoa Xo and other defendants had committed the crime of violating bidding regulations, causing serious consequences. Ms. Nguyen Thi Thanh Nhan and the defendants colluded, raised the price of the bidding package, cheated, and intentionally violated the law to create conditions for AIC Company to win the contract, causing a loss of nearly 95 billion VND.

Ms. Nhan decided to spend on “mechanism” and “diplomacy”

According to the investigation results, in order to win the bid, Ms. Nguyen Thi Thanh Nhan is the person who directly manages and directs the Financial Secretariat of AIC Company, deciding to approve and spend money “mechanism” and “diplomacy”. for Mr. Duong Hoa Xo.

Before bidding, Ms. Nhan met and asked Mr. Duong Hoa Xo to create conditions for AIC Company to win the bid and pay her thanks.

After bidding for packages from 2015-2018, Ms. Nguyen Thi Thanh Nhan directed her subordinates Tran Manh Ha and Tran Dang Tan to give money to Mr. Duong Hoa Xo 6 times, a total of 14.4 billion VND.

This money originates from money AIC Company and related companies earned from 12 laboratory project contracts.

Currently, Ms. Nguyen Thi Thanh Nhan is on the run and has not yet given a statement. However, based on the results of the investigation, document collection, data extraction, and testimony of Mr. Duong Hoa Xo and other defendants and related individuals, the Investigation Agency concluded that there was sufficient basis to identify Ms. Nguyen Thi. Thanh Nhan is the mastermind, leader, and responsible for AIC Company’s violations in 12 laboratory projects.

Because Ms. Nhan fled to avoid personal responsibility and hinder investigation activities, the Investigation Agency believes that it is necessary to handle it strictly to ensure general deterrence and prevention.

The Police Department of the Ministry of Public Security has issued a national and international arrest decision for Ms. Nguyen Thi Thanh Nhan, and at the same time called on the defendant to surrender to enjoy leniency and cooperate in the investigation to ensure the right to freedom. cure.

If you do not appear or surrender, you will be considered as giving up your right to self-defense and will be investigated, prosecuted and tried.

Reviewing the four cases of Ms. Nguyen Thi Thanh Nhan

In 2023, Ms. Nguyen Thi Thanh Nhan was tried by the Hanoi People’s Court in first instance and then the High People’s Court in Hanoi tried her appeal and sentenced her to 30 years in prison for violating bidding regulations and offering bribes. Dong Nai General Hospital.

In October 2023, Ms. Nhan continued to be tried by the People’s Court of Quang Ninh City in the case of bid rigging for the Quang Ninh Obstetrics and Children’s Hospital. In early 2024, the High People’s Court in Hanoi adjudicated the case, sentencing Ms. Nhan to 10 years in prison for violating bidding regulations…

The combined penalty for the two sentences is 30 years in prison.

The case at the Ho Chi Minh City Biotechnology Center is the third case in which Ms. Nguyen Thi Thanh Nhan has been prosecuted and is being proposed for prosecution.

In addition, in December 2023, Ms. Nguyen Thi Thanh Nhan continued to be prosecuted for violating bidding regulations in a case that occurred at the Vietnam Computer Emergency Response Center (VNCERT) under the Ministry TT-TT.
